Terms of Service

By accessing or using Skateboard Stash ("the Service"), operated by SKATEBOARD STASH PTY LTD ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or guardian. By using the Service, you represent that you meet these requirements.

• You are responsible for maintaining the security of your account and password
• You are responsible for all activity under your account
• You must provide accurate and complete information when registering
• You must notify us immediately of any unauthorised access
• We reserve the right to suspend or terminate accounts that violate these terms

• The Service requires a paid subscription to access full features
• Subscription fees are billed in advance on a monthly or annual basis
• Prices are listed in USD and local currency equivalents; prices may vary by region
• Payment is processed securely by Stripe. We never store your payment card details
• Subscriptions auto-renew unless cancelled before the renewal date
• You can cancel at any time through the billing portal or by contacting support

You retain ownership of all content you upload, including photos, collection data, forum posts, marketplace listings, and messages ("Your Content").

By uploading content, you grant us a limited, non-exclusive licence to store, display, cache, and process Your Content solely for the purpose of providing the Service. We do not claim ownership of Your Content and will not use it for any other purpose.

You are responsible for ensuring that Your Content does not violate any laws or third-party rights. You must not upload content that is illegal, defamatory, hateful, harassing, or infringes on intellectual property rights.

• We do not process payments for marketplace transactions — all payments are arranged directly between buyer and seller
• We do not guarantee the quality, safety, legality, or authenticity of listed items
• We do not guarantee that a transaction will be completed
• We are not responsible for disputes, fraud, misrepresentation, or losses arising from member-to-member transactions
• Members engage in transactions at their own risk
• We may remove listings or suspend accounts that violate these terms or community guidelines

When using forum, messaging, or marketplace features, you agree to:

• Be respectful to other members
• Not post spam, advertisements, or irrelevant content
• Not harass, bully, or threaten other members
• Not post illegal content or facilitate illegal activity
• Not misrepresent items in marketplace listings
• Not create multiple accounts to circumvent suspensions or bans
• Not scrape, crawl, or automatically collect data from the platform

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines at our sole discretion.

The Service, including its design, code, branding, and features (excluding Your Content), is owned by SKATEBOARD STASH PTY LTD and protected by intellectual property laws.

Skateboard brand names, logos, and graphics referenced in the platform are trademarks of their respective owners. They are used for identification purposes only. Skateboard Stash is not affiliated with or endorsed by any skateboard brand unless explicitly stated.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

• Your collection data is private by default
• You control whether your collection is publicly visible via your profile settings
• You can export your data at any time (CSV export)
• You can delete your account and all associated data at any time

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability to you is limited to the amount you paid for the Service in the 12 months preceding the claim
• We are not responsible for any loss or damage arising from member-to-member marketplace transactions

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including the Australian Consumer Law.

You agree to indemnify and hold harmless SKATEBOARD STASH PTY LTD, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

• You may terminate your account at any time by deleting it in your account settings
• We may suspend or terminate your account for violation of these terms
• Upon termination, your right to use the Service ceases immediately
• We will retain your data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination will survive (including limitation of liability and indemnification)

These terms are governed by the laws of Queensland, Australia. Any disputes will be resolved through good-faith negotiation first. If negotiation fails, disputes will be submitted to the courts of Queensland, Australia.

For EU residents: nothing in these terms affects your rights under mandatory consumer protection laws in your country of residence.

We may update these terms from time to time. We will notify you of material changes by email or a prominent notice on the site at least 30 days before changes take effect. Continued use after changes constitutes acceptance.
